(Meredith/WTVM) -- A five-year-old boy in Alabama was hit by a car and killed after his mother’s boyfriend attempted to discipline him by kicking the boy out of the car. 

Bryan Starr, the mother’s boyfriend, is being charged with reckless murder in the death of five-year-old Austin Birdseye, according to Sheriff Heath Taylor. 

The sheriff said Starr was driving when he pulled over and told the child to get out of the car for being ‘unruly’.

"It was raining at the time and it was, obviously at 8 o'clock at night, dark,” Sherif Taylor said. 

Starr reportedly told officials he lost sight of the boy until he saw cars stopped on the road. 

Austin was still alive when help arrived, but was later pronounced dead at the hospital.  

"He has no idea where he is or how to get home. Who thinks to tell a five year old to get out of a car because they're being potentially loud?" the sheriff said.
