Prosecutors intend to seek death penalty in case of murdered Clinton officer

HENRY COUNTY, MO (KCTV) -

Missouri state prosecutors have announced that they intend to seek the death penalty for the man suspected of shooting and killing a Clinton police officer in August 2017.

Ian McCarthy is charged with one count of first-degree murder and one count of armed criminal action after Clinton police officer Gary Michael was shot and killed during a traffic stop.

Prosecutors say they intend to prove five statutory aggravating circumstances of the incident.

First, “The murder in the first degree was committed by a person who has one or more serious assaultive convictions.”

McCarthy pleaded guilty to the Class A felony of robbery, brandishing a knife and threatening a woman during the course of a theft in Hillsborough County, NH, in 1998.

Second, “The murder in the first degree was committed by a person who has one or more serious assaultive convictions.”

McCarthy was convicted by jury of the Class A felony of first-degree assault by knowingly causing bodily injury to another person by means of a deadly weapon, Hillsborough County, NH, in 2003.

Third, “The murder in the first degree was committed against a peace officer during or because of the exercise of his official duty.”

Fourth, “The murder in the first degree was outrageously or wantonly vile, horrible or inhuman in that it involved depravity of mind as defendant's selection of Gary Michael to kill was random and without regard to the victim's identity and that Defendant's killing of Gary Michael thereby exhibited a callous disregard for the sanctity of all human life.”

Fifth, “The murder in the first degree was committed against a peace officer while engaged in the performance of his official duty.”

The state made the announcement on Wednesday.
