KANSAS CITY, MO (KCTV) -

A newly renovated high rise apartment in downtown Kansas City is facing scrutiny after tenants say they lack proper air conditioning and heating.

One tenant also says the building’s roof is leaking and ruined valuables he had in his storage unit.

Don Budd said he recorded video following a water leak in the storage unit of his apartment complex. Some of his belongings were underwater.

The avid shoe enthusiast and sports memorabilia collector says he's out thousands of dollars and sentimental items like childhood pictures are ruined.

“After I think I grasped what was going on, it was hard, because a lot of it, I’m never going to get back," he said.

Budd says his woes started after mold was discovered in his two-bedroom apartment on the 30th Floor of Commerce Tower. He says he was relocated to another unit and that's when he put some items in storage.

He said one day, he got a call about a small leak while at work. He now says the apartment complex is unwilling to pay for the damage and also claims the building has a heating and cooling issue.

"There's no heat in the winter time," he said. "It got down to 40 degrees in my unit."

Commerce Tower was built in the 1960s and was one of the first modern skyscrapers in downtown. It was recently renovated into an apartment complex.

Budd's attorney has sent a demand letter to the owners, but said his next step would be a lawsuit.

Paige Bremner, Budd's neighbor, says she hasn't had any major concerns.

“I haven’t had any problems," she said. "I think there’s always going to be problems when you move to a building that’s under construction.”

KCTV5 reached out to management Wednesday and to the owner to find out why they are not paying Budd back for his items.  We have not heard back.

Budd says he’s moving out next month when his lease is up.
