On Friday, prosecutors took their first steps in building the case against the man accused of killing a Clinton police officer.

Ian McCarthy appeared before a judge from jail via video conference less than three blocks from where Officer Gary Michael was killed almost a week ago.

McCarthy is accused of killing Michael late on Sunday night.

Family and friends of the officer were emotional when they saw his accused killer for the first time.

The judge entered a not guilty plea on his behalf.

The prosecuting attorney explained why there was no bail: “McCarthy’s warrant was specified as being without bond, which is not uncommon in a case where the death penalty is a possibility.”

Whether or not he'll face the death penalty will not be decided until a consultation with other prosecutors and consultation with family.

Family and friends are left to wonder why this happened. The prosecuting attorney said, "I don't know if he had any specific animosity toward Officer Michael."

McCarthy is expected to be back in court in October.

The second man, William Noble, was also charged in connection with the murder.

Noble was wearing a suicide prevention vest when he saw a judge for the first time today.

Noble, who does not have an attorney yet, filed for representation from a public defender.

He is accused of giving McCarthy the gun then hiding it while McCarthy was on the run for almost 48 hours.

Bond was not discussed for Noble either.

When asked what the chances were of the case staying in Henry County and whether there had been a discussion about moving the trial elsewhere, the prosecuting attorney said, "Well, not at this point and that designation doesn’t get made at this stage in the proceeding."
