WASHINGTON (KCTV) -

Adam Purinton has been indicted by a federal grand jury on hate crime and firearm charges for shooting three men - including two Indian nationals - at an Olathe bar in February.

The Justice Department said the announcement was made by Acting Assistant Attorney General Thomas E. Wheeler, II, head of the Justice Department’s Civil Rights Division, and United States Attorney Thomas E. Beall of the District of Kansas.

The indictment accuses the 52-year-old of shooting and killing Srinivas Kuchibhotla because of Kuchibhotla’s actual and perceived race, color, religion and national origin.

The indictment also accuses Purinton of attempting to kill Alok Madasani because of his actual and perceived race, color, religion and national origin.

A third count in the indictment charges Purinton with violating a federal firearms statute by discharging a firearm at Kuchibhotla, Madasani, and the third man, Ian Grillot, during those crimes of violence.

The indictment alleges that Purinton committed the offenses after substantial planning and premeditation, attempted to kill more than one person in a single criminal episode, and knowingly created a grave risk of death to others on the scene.

The statute authorizes a maximum penalty of death or life in prison; the Justice Department will determine at a later date whether, in this particular case, it will seek the death penalty.

The chief of the Olathe Police Department released a statement:

On behalf of the Olathe Police Department and I believe our community, we are pleased that federal authorities and a grand jury have brought charges in this hate crime. Our thoughts continue to be with Srinivas’ family as well as Alok and Ian. We won’t forget that families are still grieving. And we also won’t forget the impact on our community.

These crimes shocked all of us in Olathe and the Indian American community. As I have said before, this evil act does not and will not define us, but rather brings us closer as a community.

Based on the facts of this case, I believe the hate crime and weapons charges are appropriate and warranted. And I believe our community expected these charges.

I fully trust the judicial process, and I fully expect justice to be served fairly and expeditiously.

Finally, I would like to thank our federal partners in this investigation including the Kansas City Office of the FBI, the U.S. Attorney’s OfficeDistrict of Kansas, and the U.S. Department of Justice.

The mayor of Olathe released a statement as well:

On behalf of the Olathe City Council and our community,

The shooting at Austin's Bar and Grill will always have an impact on this community. It has been painful for all of us, and we will always hold Srinivas and his family in our hearts.

We believe the federal hate crime charge reflects the severity of this crime and is certainly appropriate. It is our hope that the federal process will move fairly, yet quickly to help start closure for Srinivas' family and friends who are grieving, Alok and Ian, and of course, this entire community.

If the intent of this one act was to spread hate, it failed miserably. It has spread love, and it has brought this community even closer together. This city will continue standing as One Olathe with Srinivas' family and friends and all those who have suffered, and no act of hate will ever change that.
