A wrongful death lawsuit has been filed against a teen and his family in Overland Park.

In August, Kevin Moroney was standing next to a parked car on Tomahawk Road near 85th Street when a car hit him and another woman. Moroney died at the scene while the woman was injured.

Prosecutors say the driver, 17-year-old Conner Estrella, was drunk. He has been charged with involuntary manslaughter and aggravated battery.

The Overland Park teen was on probation from a previous battery case and was not supposed to be drinking alcohol or attending parties where alcohol was present.

The Moroney family released a statement saying, "Too often, some parents have turned a blind eye to what is becoming a dangerous epidemic. Whether parents are knowingly allowing their children to drink or simply failing to keep tabs on what their children are doing in their free time, this is a problem that everyone in our community must address, including teens, parents, the police and our courts."

On Wednesday, the family spoke with KCTV5. They say the parents provided him the vehicle he was driving, despite knowing the restrictions on him and his history of issues.

"The kid himself has the ultimate decision to make," Blakelund Moroney said. "But the parents can shed as much light as they can and discipline and be there for their kids to help them make the best decisions."
