Pool company blamed for mounds of dirt, holes

Customers of a Columbia pool company said work suddenly stopped on their pools last month, leaving them with gaping holes and mounds of dirt in their yards.

A recording of the company's owner shows him telling a customer that his attorney advised him not to talk to any more of his customers.

Amy Harvey and Reiner Vanooteghem live just a few houses away from each other, and both hired Aqua Pools and Yardscapes, LLC.

Now, both have mounds of dirt in their yards and unfinished pools.

"Pretty much everything has to be redone, it's just a mess," Harvey said.

"It's tough to take," Vanooteghem said.

Both said the work stopped early last month. So Vanooteghem called the company's owner, Joe Spann.

"He said, 'I don't have any more money.' Said, 'I have no money,'" Vanooteghem said.

Harvey said she's out of money too.

"We've paid 90 percent of the completion of the pool. We didn't finance, we didn't take loans out. We saved every penny and worked hard. Now we don't have anything to finish it," Harvey said.

Both required Spann to sign contracts at the beginning of the project.

Both did their research, speaking to his old customers and checking the Better Business Bureau website. Aqua Pools and Yardscapes had a good reputation.

Harvey also asked Spann why the work was unfinished.

"'Just had a rough year, didn't have the right laborers,' is what he says," she said.

To document the situation, Harvey recorded their last conversation last week.

In the recording, you can hear Harvey ask Spann if he has no money, how he intends to finish her job.

"I'm still able bodied," Spann can be heard saying. "I'm not going to let you take the fall. I will get your pool finished."

Spann agreed to talk to the Channel 4 I-Team about the unfinished work, but when he spoke with his attorney, he decided against it.

According to the recorded conversation, he's talk to his attorney a lot.

Harvey's husband asks why Spann won't put in writing that the Harveys won't be out any more money.

"I can't. My attorney won't - he told me not to even talk to people. But I can't. I am going to talk to you guys," Spann said.

The Channel 4 I-Team has also spoken with a third customer who said his pool isn't completed either.

Spann did send the Channel 4 I-Team an email, reading, "We are actively working to resolve this matter in a fair and amicable manner. Aqua Pools has built numerous pools for satisfied customers, and we thank you for your patience."
