Rusty Mack's wife testifies against former friend on trial for murder

CHESTERFIELD, VA (WWBT) -

Testimony resumes tomorrow in the case of a woman charged in the beating death of a Colonial Heights man.

Margaret Blair Dacey is charged with the murder of Rusty Mack. He died in February 2013. Prosecutors say they will prove that Dacey delivered the fatal blow by kicking Mack in the head. According to witnesses they say she told them it was because Rusty sprayed water on her when he fell.

Both sides called several witnesses including Ashley Mack, Rusty's wife, who was there that night and once faced charges in this case. Those charges have been put aside.

Witnesses were asked to go over the night Mack was beaten. There was a group of four people including Ashley Mack, Dacey and two other men whose charges have already been dropped. A neighbor testified that he saw Mack yelling at Ashley. She pushed him, and he fell, but his head never hit the ground.

That's when the neighbor said Dacey kicked Mack in the head, saying he heard the thud. Ashley Mack told the court that the next day Dacey bragged that she had, "kicked the (expletive) in the head" and asked her friends to file charges against Mack. He died from his injuries almost two weeks later.

The defense said it intends to prove Rusty wanted to fight anyone that night and tried to show inconsistencies in Ashley Mack's testimony.

The jury consists of eight women and five men. They will be in the courtroom Thursday morning. The trial is expected to last until Friday.

There are two special prosecutors from Stafford taking on this case and the presiding judge is from Portsmouth. All these moves to make sure there is no bias in this trial.
