DeKalb County judge orders deputies to arrest Pamela Ballin

New developments In the case of a woman who was convicted of murder -- then released by the judge

Wednesday that same judge issued an order for Pamela Ballin's arrest. She turned herself in to police around 6 a.m. Thursday.

The move comes one day after CBS46 reported that the DeKalb County District Attorney filed an emergency motion for the arrest.

Judge Mark Anthony Scott set Pamela Ballin free last week after a jury convicted her of murdering her husband-- while he decides whether to overturn that conviction.

In his order, Judge Scott said the state did not make him aware that Pamela Ballin's bond had expired.

Evora Ritchie was happy when she found out DeKalb County District Attorney Robert James took action Tuesday to have Pamela Ballin arrested immediately.

"We're really elated. I'm glad he did that. Hopefully the judge will make the right decision on the 17th and incarcerate her," said Ritchie.

A jury convicted Pamela Ballin of murdering her husband, Derrick "Ricky" Ballin, last week. She was found guilty of malice murder, felony murder and aggravated assault.

Ricky Ballin was found beaten to death inside the couple's DeKalb County home in December 2009.

Pamela Ballin told police some intruders beat her husband during a home invasion. Prosecutors didn't buy it. Pamela Ballin was indicted and subsequently convicted, but instead of sending her to prison, Judge Mark Anthony Scott sent her home.

"We were all in the court and saw the evidence. Twelve people saw the evidence and pronounced her guilty. I don't know what to say about that," Ritchie said.

Scott sent Pamela Ballin home after the jury convicted her because he is deciding whether or not to overturn the jury's decision.

The DA filed an emergency motion which states in part:

"As a matter of law, Pamela Ballin must be taken into immediate custody since a jury found her guilty of malice murder, Ballin has been released into the community with no bond; Judge Mark Anthony Scott has no discretion and must impose a mandatory life sentence and judge Scott has no legal authority to enter a post-verdict for mistrial."

"Not a day goes by that we don't think about Ricky because it's hard. We just want to have her prosecuted and locked up."
