Gardner school board agrees to pay fired administrators through June 30

The Gardner-Edgerton School Board has voted to pay three fired administrators through June 30 after previously refusing to pay them any additional monies.

Last week's decision comes after a divided school board on Feb. 27 had agreed to fire Superintendent Bill Gilhaus and two of his top administrators, Lana Gerber and Christina Ziegler.

At the time, the board had stopped paying them effective Feb. 27.

The board had agreed on May 12 to pay the three through June 30, which is when the fiscal year concludes. The payments will include everything that their contracts called for them to be paid for.

"To the extent any of the three administrators has reasonably advanced any sums for contractual benefits, which were not provided as set forth in the employment contracts, the administration may reimburse the three administrators for those sums," according to the resolution.

The law firm for the three administrators released the documents on Tuesday, not the district.

The three administrators have taken the initial steps needed that could lead to a lawsuit against the school district over their firing.

Their attorney, Dennis Egan, told KCTV5 that he and his clients had insisted that the payments be restored. He said failure to pay had breached their contract and he was unwilling to entertain any discussions about how to resolve their differences until the payments were made.

"It is a start," he said.

He said either the district will settle the case or his clients will pursue legal action, saying the board failed to follow due process procedures and violated their contracts in firing them with no warning or cause.
