Defense want ex-officer Chrisman's conviction tossed

PHOENIX (CBS5) -

Attorneys for former Phoenix police Officer Richard Chrisman are fighting for a new trial.

A motions hearing was scheduled for Wednesday at which Chrisman's attorneys will ask a judge to throw out his conviction for aggravated assault in the death of a Phoenix man.

Chrisman was convicted in September in the shooting deaths of Daniel Rodriguez, who was unarmed, and his dog during a domestic violence call three years ago.

The jury was hung on animal cruelty and second-degree murder charges.

Chrisman's attorneys are accusing Deputy County Attorney Juan Martinez of prosecutorial misconduct.

If the verdict stand, Chrisman could face up to 15 years in prison when he is sentenced later this month.
