A well-known Tennessee gun rights advocate is scheduled to make a court appearance on Tuesday after being stopped walking down a busy downtown street dressed in body armor and carrying an assault-style rifle.
Leonard Embody was he was only protecting his rights when police stopped him while walking down a busy downtown street when he was arrested July 29.
Leonard Embody was dressed in body armor and was carrying an assault-style rifle slung around his shoulder.
It's the third encounter Embody has had with police over gun rights since 2010, and this latest encounter happened during the busy rush hour, not far from the state Capitol building.
Metro police began receiving calls at about 3 p.m. from startled passers-by, so Central Precinct Commander Jason Reinbold stopped Embody near the intersection of Third and Deaderick Street.
Reinbold's question was simple and direct.
"Sir, is that a real gun?" said Reinbold.
Embody refused to answer the question.
"I'm invoking my Fifth Amendment rights," said Embody.
The encounter went on for almost 10 minutes, and it wasn't until officers inspected Embody's case that a firearm silencer, or suppressor, was found.
Embody was arrested when he could not produce legal paper work for the suppressor, and he was charged with unlawful possession of a prohibited weapon.
Police could not say whether the rifle was loaded. They said Embody had rigged a lock around it so they couldn't tell if the chamber was empty.
In 2010, Embody was stopped by a park ranger at Radnor Lake State Park while carrying a similar assault-style rifle after walkers along the trail became concerned. Embody was detained and released when he produced a carry permit.
A similar incident occurred along Belle Meade Boulevard that same year.
