Did Cleveland City Councilman Eugene Miller violate the city's charter? If he did, should he, and will he, lose his council seat?

That's the debate raging now inside council as the jockeying for position in the November election is well underway.

This much is certain, Cleveland City Council is shrinking, from 19 members to 17, so wards were redrawn and with that Councilman Eugene Miller will be running in the new tenth ward.

"Now I got a little excited last Friday and changed my voter registration file, anticipating in the future that's where I'll be living at," said Miller.

But Miller re-filed his voter registration to a home on East 114th street, which is not in the ward he currently represents and the city charter states that council members forfeit their seat if they move out of their ward.

Miller subsequently re-filed his voter registration back to the home in the district he currently represents and claimed he never actually moved, "I don't plan on moving until the election is over and that's in January of next year, when I win, I want to make sure it's very clear," he said.

But Miller's opponent in November, current council colleague, Jeffrey Johnson said that he believes changing your voter registration is considered a legal move of a residence, and expects that some residents of Miller's current ward will ask the city's law department and council to investigate to see if Miller violated the charter.

Johnson also said he believes that since Miller did not physically move, that he, in turn, filed a false form with the Board of Elections and he will ask the Director of the Board to make a ruling.
