Independence teen dies after fall from moving car

An Independence teenager is dead after an accident that started with he and his friends just joking around. 

It was a typical summer day spent at the pool for 16-year-old Cody Dayberry. His friends were only going a few miles an hour when he fell from the back of a car. 

Dayberry died from his injuries.

"Cody was a very kind, loving and giving person. I'd give my soul to have him back," his mother, Susan Dayberry, said.

Police said the teen was riding on the back of a friend's slow-moving car Tuesday afternoon in the Highland Manor trailer park off 40 Highway when they turned a corner and the teen either fell or tried to jump off.

His mother's fiance, Greg Mastin, witnessed the whole thing.

"I said, 'Get off that car Cody. What are you doing?' And they turned, and I heard a thud. I didn't know what it was, so I walked over and saw him lying in the road," Mastin said.

Police said he slammed his head on the cement. He was rushed to an area hospital and later transferred to Children's Mercy but passed away early Wednesday morning.

While Susan Dayberry tries to come to terms with what has happened, she is grateful that her last memory of her son is a positive one.

"We always hugged and kissed and said we loved each other," Susan Dayberry said.

Cody Dayberry would have been a junior at Truman High School next fall. There is no word if the teenage driver will face any charges.

The Independence School District issued a statement saying, "Cody Dayberry was a member of the Independence School District community and attended Truman High School last year. Our thoughts and condolences are with the family and friends of the teenager."

The district said they will have counselors on hand to support those close to the tragedy.
