Kansas congressman Kevin Yoder introduced the Kelsey Smith Act on Monday into the 113th Congress.
The legislation is named after Smith who was abducted and murdered in June 2007.
It was four days between the time she disappeared when her cell phone location information was released, and her body was found.
The legislation is currently law in nine states throughout the country, but Yoder and the Smith family want it to be a national law.
"The Kelsey Smith Act just says if it's an emergency situation, if there's a danger of loss of life, if there's a danger that somebody is in serious bodily harm, release the information to law enforcement. And the only information released is the location of where is the telecommunications device is at," Smith father, Greg Smith, said.
The states that have the system in place already have reported several "saves," where people that have been saved from the use of the law.
Currently, the law says service providers are allowed to release the location information, but does not require them to do so.
