Report: K9, stun gun used to subdue Steven Brooks

BARSTOW, CA (FOX5) -

A disagreement over tow truck fees gave way to a high speed pursuit involving former Nevada lawmaker Steven Brooks who faced his third arrest in three months on Thursday.

According to the Barstow, CA, Police Department, officers arrived at a location along southbound Interstate 15 near Lenwood Road just before 6:15 p.m.

Police, in an incident report, were called to a disagreement between a tow truck driver and a man later identified as Brooks, who just hours before was expelled from the Nevada Assembly.

According to the report, the tow truck driver claimed he was being defrauded by Brooks over payment. Brooks, in the report, turned away from officers while they spoke to the drive and ran back to his vehicle.

Police said Brooks ignored commands for him to stop and even did not comply with officers when he entered his vehicle.

He then turned on his vehicle and accelerated down the highway, the report said.

Troopers and deputies from California Highway Patrol and the San Bernardino Sheriff's Department were dispatched to the chase, police said.

Officers, in the report, observed a front tire of Brooks' vehicle was already flat, which resulted in smoke and sparks on the highway. The vehicle, though, was still traveling at a high rate of speed and weaving in and out of lanes, police said.

In the report, police said metal objects were also being thrown out of the vehicle.

Brooks continued until a spike strip was used, stopping the vehicle on the highway near Stoddard Wells Road, police said.

Brooks, in the report, eventually exited the vehicle but was acting irrationally, continuing to refuse orders by officers. Police said a canine officer was used to subdue Brooks, but, instead, he began choking the dog and hitting the animal with a metal socket wrench.

Officers were able to get a hold of Brooks and attempted to place him in handcuffs, the report said, but not before a stun gun was used during a struggle.

Brooks was taken to a nearby hospital for evaluation before being transported to West Valley Detention Center in Rancho Cucamonga, CA. Brooks was booked on charges including felony evading, willful harm to a police service dog, resisting a peace officer with force and throwing objects from a vehicle. He is being held on $100,000 bail.

Police noted the canine was treated for lacerations above the eye and left leg.

On Friday, a YouTube video surfaced purporting to depict Brooks' arrest at the end of the high speed pursuit. In the clip, an officer appears to strike a downed person during the arrest.

The arrest came on the same day his colleagues voted to boot Brooks from the Nevada Assembly, marking the first time in the state's history a lawmaker was expelled from a legislative body.

"He was very agitated," said Kris Reilly of the Victorville Daily Press. "He was screaming and yelling random things. As he was being loaded onto the ambulance he said something to the effect of these cops are going down."

Brooks' attorney Michell Posin said Thursday, "I'm disappointed that there was another episode with him. Clearly he was upset with everything that had gone on."

His job was on the line following arrests over the last two months. He faces charges for threatening Assembly Speaker Marilyn Kirkpatrick, as well as unrelated charges to a domestic incident and resultant scuffle with police.
