HAMMOND, OR (KPTV) -

A suspected burglar is being treated at Legacy Emanuel Medical Center in Portland for a gunshot wound to his hip, according to Warrenton Police.

Police state 25-year-old Tony Tischer broke into a home in the 1000 block of Third Ave. at 7:15 p.m. Friday.

A neighbor called 911 and told police the homeowner was holding the burglary suspect at gunpoint. As officers arrived on scene, police said the 44-year-old homeowner shot the suspect in the hip.

Paramedics rushed him to the hospital where his condition was unknown Saturday evening.

Police said officers arrested Tischer for breaking into the same house Wednesday. He was released from jail the next day due to overcrowding.

"How could a man get out like that and come back to the same place," said neighbor Dwayne Rhea. "I don't know what's wrong there."

Police said Tischer had been staying at a nearby RV park and has no relation to the homeowner.

The homeowner turned his shotgun over to police and was cooperating with the investigation.

Warrenton police are still investigating and will work with the District Attorney's office to determine if any charges will be filed.
