Caretaker accused of sexually assaulting client at Merriam center

A 56-year-old KCK man is charged with aggravated sexual battery, but it is who he is accused of assaulting that has multiple agencies investigating.

Brian Schmidt, a caretaker at Trinity Nursing and Rehab Center, a faith-based organization in Merriam, is accused of sexually assaulting a woman who was a client at the center.

Staff are they are conducting a full review of their policies.

"In regards to the allegations against Mr. Schmidt, we cannot comment on an open investigation, but we are fully cooperating with local law enforcement and other state agencies regarding the alleged incident," administrators at the center said in a written statement.

Most of the court records are sealed, but police say the victim is in her 40s and is described as mentally deficient.

Police started their investigation last November. Their report shows two other employees are witnesses.

Schmidt would not comment on the allegations.

The allegations came as a shock to those coming to visit loved ones Wednesday at the center.  Several said this was the first they've heard of the news, and they were never alerted by staff.

Trinity Nursing and Rehab Center has a five-star overall rating from Medicare. It has had no penalties over the last three years and only five health deficiencies in its last inspection.

According to Medicare, the average number of health deficiencies during an inspection in Kansas is 10.
