Man is free after rape, battery charges dropped

Erick Wanijku is a free man after rape and battery charges were dropped against him.

Wanijku spent almost a year in jail after he was accused of raping a woman he met at Saints Pub and Patio in Lenexa and then biting a bouncer who held him down until police arrived.

Witnesses who saw the woman after the encounter are unhappy with the charges being dismissed.

The rape charge was recently dropped and a judge dismissed the battery charge Tuesday after the bouncer was unable to appear in court. Wanijku had said the encounter with the woman was consensual.

Attorneys, citing Kansas privacy laws, said they cannot discuss the case.

Johnson County District Attorney Steve Howe said there were serious evidentiary issues that led to the dropping of the charges. He said he wishes this was different, but his only recourse was to drop the charges.
