Charges Could Be Upgraded Now That Victim Is Dead

HOLDEN, Mo. -- Three people are in custody after a woman was shot and killed in her boyfriend's home.Scott White said he knew one of the three people who came into his home on Missouri Route 131 in Holden, Mo., but he didn't know one of them had a gun."I saw him out of the corner of my eye," he said. "When I turned around there was a gun in my face."White said the man fired the gun, missing his head by inches but coming close enough to knock off his hat. White then ran away but he said two of the people in custody went inside his house and shot and killed his girlfriend."I'm glad they caught them," he said. "But there's no consolation prize because my girlfriend's life was taken."Lisa Smith, 41, was shot in the head. Her family said she was taken off of life support at a Kansas City hospital."Lord forgive me for this but I hope they rot in hell," said the victim's mother, Shirley Jamison.Deputies and Missouri Highway patrol caught all three suspects as they attempted to get away on Route 131. James Vincent Vitale, Dee Anne Pagel and Jason Raymond Booth were charged with first-degree assault and armed criminal action. Now that Smith has died, the sheriff said charges could be upgraded to murder.The sheriff said the incident started as an attempted robbery .
