A police officer accused of slapping an elderly man tried to avoid KCTV5 News cameras as she left court Thursday.

Kimberly Whyley is charged with assault. She professed her innocence as she left the courthouse.

The Oakview, Mo., police officer is accused of slapping Phil Forte, 88, in the face after she pulled him over on North Oak Trafficway in February.

A guardian for Forte has filed a lawsuit against Whyley and Oakview for $5 million.
