Judge Clears Way For Possible Sentence

A judge cleared the way for the death penalty Tuesday in the high-profile Kelsey Smith homicide case.

Defense attorneys, citing a technicality, had asked the court to take capital punishment off the table for their client, Edwin Hall.

Late Tuesday morning, a judge denied that request, clearing the way for the death penalty if Hall is convicted in the case.

Smith was killed after she was taken from the parking lot of an Overland Park Target store in 2007.

Hall's attorneys tried to convince the judge that a clerical error in paperwork should have spared their client from a possible death sentence.
