OLATHE, Kan. -- A 16-year-old charged as a juvenile in connection with the death of his classmate after a fight will be tried as a juvenile, a Johnson County judge decided Wednesday. The judge's decision followed a day and a half of testimony about whether he should be tried as a juvenile or an adult.Dakota DeRemus was found dead near his Gardner, Kan., home in February.Authorities initially investigated his death as a suspicious one, but after an autopsy revealed he had a heart problem, police ruled his death a homicide and took the other teen into custody.DeRemus had been involved in a fight with the other teenager and died after the fight, police said.Johnson County juvenile authorities then charged the other teen with involuntary manslaughter in connection with DeRemus' death.District Judge Brenda Cameron said she was influenced by the 16-year-old's clean record and his good behavior while being held by juvenile authorities. She ordered him released into the custody of his parents and placed under house arrest.
