Teen Accused Of Killing Classmate Could Be Tried As Adult

Video Of Deadly Fight Played In Court

A hearing was under way Tuesday at the Johnson County Courthouse to determine whether a 16-year-old charged as a juvenile in connection with the death of his classmate after a fight should be tried as an adult.

Dakota DeRemus was found dead near his Gardner, Kan., home in February.

Authorities initially investigated his death as a suspicious one, but after an autopsy revealed he had a heart problem, police ruled his death a homicide and took the other teen into custody.

DeRemus had been involved in a fight with the other teenager and died after the fight, police said.

Johnson County juvenile authorities then charged the other teen with involuntary manslaughter in connection with DeRemus' death.

Prosecutors said the accused teenager was not motivated, didn't care about much and failed at whatever he tried, but four of his teachers testified that even though he struggled academically, he was a typical teenager.

Prosecutors called teachers as witnesses who testified that the teenager accused was sometimes unruly at schools, but the defendant's attorney said he and DeRemus had agreed to fight.

In court, cell phone video of the fight was played. Another teenager who witnessed it recorded the video. The video showed DeRemus collapsing onto the ground after being hit several times.

An interrogation tape also was played in court.

On that tape, the teenager charged told investigators he hit DeRemus 18 or 19 times. He also said he tried to help DeRemus after the fight.

A Johnson County court services worker testified that she believed the accused teenager should remain in the juvenile system.

DeRemus' parents have said that their son was bullied at school.

No decision was made in court Tuesday, but the hearing was expected to continue Wednesday afternoon.
