AG Sues Car Dealership Over Ad Campaign

KANSAS CITY, Kan. -- Kansas Attorney General Steve Six is seeking to close down a Kansas City, Kan., car dealership over what he alleges was a fraudulent advertising campaign.Six filed a lawsuit in Wyandotte County District Court on Monday against Chad Franklin Suzuki -- which has changed its name to Legend Suzuki -- alleging it engaged in "unconscionable and deceptive" business practices.In television and radio ads that ran in the Kansas City area from June 26, 2007, to Jan. 27, 2008, the car dealership offered customers a chance to either drive a new Suzuki for life with no payments, or to drive a new car for a fixed time at a low, fixed price.Six alleges that about 650 customers who responded to the advertisements had to make full payments after the dealership stopped the promotion with no notice. He also alleges that the dealership limited customers' ability to negotiate on their contracts.The attorney general filed six counts of unconscionable acts or practices and six counts of deceptive acts, all which violate the Kansas Consumer Protection Act.The lawsuit asks that Chad Franklin Suzuki stop doing business in Kansas, pay restitution to customers affected by the "Drive a Suzuki" promotion, release all consumers from contracts arising from the promotion and pay civil penalties to the state.A man who answered the phone Monday at the dealership said no one was available to comment.Chad Franklin sold the dealership within the past few weeks.
